TERMS AND CONDITIONS

GENERAL

The reservation terms below form the basis of your agreement with YELOFUN Travel Agency LLC (“we”, “us”, and “our”). Please read them carefully as they set out our respective rights and obligations. By asking us to confirm your reservation, we have the right to assume that you have had the opportunity and have read these reservation terms and to accept them.

These reservation terms apply only to travel arrangements that you book with us in Poland via our website(yelofun.com) and which we agree to make, provide or perform (as applicable) as part of our contract with you. All references to “trip”, “booking”, “contract” or “arrangements” in these booking conditions mean such trip arrangements unless otherwise stated.

 

1. BOOKING AND PAYMENT

1.1 To secure seats, participants must complete the full payment using any of the options we provide. YELOFUN accepts a booking on the condition that full money has been collected and kept by YELOFUN or one of our authorized payment partners.

1.2 All prices are quoted, processed, and received solely in PLN currency. YELOFUN is not liable for any currency conversion fee charged by 3rd Party banks.

1.3 After we receive full payment, your booking will be confirmed subject to availability and at our discretion. We will hold your seat on the picked trip. However, it is purely your responsibility, as the customer, to double-check the booking information and travel dates.

1.4 YELOFUN will send you a booking confirmation with a booking ID as confirmation of your reservation. This confirmation certificate is required in order to participate in the chosen tour. This document, along with a valid travel document, must be presented at the time of boarding. If booking information is determined to be false or in violation of our terms and conditions, a YELOFUN representative reserves the right to refuse entry to the bus.

1.5 We do not accept installment payments. Each payment must be made on the agreed-upon dates. If the payment is not made by the agreed-upon deadline, the reservation will be canceled. If a participant decides to terminate their participation after completing the cancellation policy requirements, refunds will be issued within the next four working days.

 

2. TRAVEL SERVICE DESCRIPTION

2.1 Day trips organized by YELOFUN do not include accommodation, but for trips lasting more than one day, shared accommodation for each night and round-trip transportation by comfortable rental bus is included. Room preference is subject to availability and is in discretion of YELOFUN representatives allocating the rooms. However we always try to do our best for your room preference.

2.2 YELOFUN reserves its permission to change/modify the conduct of the trips due to unavoidable reasons. This includes the cancellation of the trip itself. As a result of canceling the trip, you will receive a full refund.

2.3 There will be a YELOFUN team leader on all trips. The leader will give all participants information about the trip, helps them with any possible problems, and can give you recommendations on where to see in the cities to be discovered. However, note that the leader is not a tour guide and is not responsible for the historical and/or detailed information of the cities.

 

3. INSURANCE POLICY

3.1 There is no travel insurance included in the price of any Yelofun tour, package, or any other possible products.

3.2 We highly recommend all participants have their own insurance that covers all possible issues of travel.

3.3 As a travel guarantee, our company is in cooperation with a Polish Guarantee Found. In the case of a bankruptcy or such, all participants have the right to get a refund and preserve their rights.

 

4. WEATHER, ENVIRONMENTAL, POLITICAL, OR ANY OTHE UNEXPECTED CONDITIONS

4.1 YELOFUN cannot be held responsible for the changes that have to be made by environmental conditions such as storms, and sudden weather changes. Passengers do not have the right to cancel the trip because of the weather conditions. Only Yelofun LLC. can decide this and take precautions when needed.

4.2 We may not be held responsible for delays due to labor disputes, border problems, or other political factors. 

4.3 YELOFUN may not be held responsible for delays due to road conditions, traffic jams, or other issues that may arise and are outside of our control.

 

5. CANCELLATIONS/CHANGES

5.1 Discounts, promotional fees, sales fees, and package deals are neither transferable nor refundable.

5.2 Promotional trips such as donations, sponsorships, or awards are personal and non-transferable.

5.3 Coupons / Gift Certificates are non-refundable.

5.4 In general, it is possible to transfer a ticket to another person. By doing this, you have to pay a change fee for each change event depending on the type of trip (30PLN for a day trip, 60PLN for a multi-day trip). This change and payment must be made by you by sending an email to info@yelofun.com

5.5 It is possible to change the city of departure if there is still availability on the bus. By doing this, you are responsible for paying the fee difference (if any) and a change fee for each change (30PLN for a day trip, 60PLN for a multi-day trip).

5.6 Any cancellation must be done by you by sending an email to info@yelofun.com

Two refund options are available:

  1. Voucher refund: By choosing this option, you will be provided with a non-transferable voucher that can be used for future multiple purchases with YELOFUN. The voucher shall have a validity of 12 months, after which it is irreversibly disabled. Any unused balance is automatically fortified.
  2. Money refund: by selecting this option, a refund will be processed by YELOFUN within 14 working days. The bank account details used for the payment have to be provided, in order to receive the money back.

5.7 The cancellation of a trip booked by you is irreversible. The following cancellation and refund policies apply:


5.8 No refunds will be made for the unused portion of the ticket or the partially completed trip.

5.9 Although it is highly unlikely, tours may be canceled or changed by YELOFUN  due to a lack of the minimum number of participants or other unforeseen circumstances. We reserve the right to cancel/change tours up to 12 hours in advance before departure. In the event a tour is canceled or changed, you will be notified via email or phone. In the event of a cancellation by YELOFUN, you will receive a full refund for the amount paid within 14 days after the cancellation of the trip.

6. VOUCHER CERTIFICATES

6.1 Voucher certificates offered by YELOFUN can be used with multiple purchases and are linked to your email ID. However, vouchers are non-transferable and non-refundable.

6.2 The validity of vouchers may differ depending on the situation. The effective validity is as stated on the voucher.

6.3 Redeeming only one voucher certificate per transaction is possible. Voucher certificates can not be used in combination with any other promotions.

6.4 It is therefore entirely your responsibility to maintain the confidentiality of your voucher certificate.

 

7. PASSENGER RESPONSIBILITIES

7.1 It is your responsibility to make sure you have all valid travel documents like your passport, visa, permits, and certificates for your selected trip. YELOFUN is not liable for any problems, delays, or denied entry in the event you are not in possession of valid travel documents. In the case of lost or stolen documents, while we are happy to assist in any way possible, we cannot be held responsible for any additional costs and you are not entitled to any reimbursement or compensation for paid travel expenses. Our team leader retains the right to exclude you from the bus at any time during the tour if you are traveling with invalid documents.

7.2 You agree to comply with the authority of the team leader, and the laws and regulations of the countries visited, including customs and foreign exchange restrictions. If you do not comply with said regulations, you will be asked by the team leader to leave the trip. You are not eligible for any refunds under such circumstances.

7.3 There may be some moments when the YELOFUN team leader must make a decision for the safety and/or the best interests of the group. It is a condition of booking that you comply with the authority and decisions of the team leader. If you do not comply, or if in the opinion of the team leader you are not compatible with the general enjoyment of the group or the smooth operation of the trip, YELOFUN reserves the right to refuse you to continue with the trip. You agree that we have the exclusive right to dispel you from a tour at any time, without any claims or complaints by you against us. In such a case YELOFUN will not be liable for any refund, compensation, or additional costs incurred by you.

7.4 Any fines/penalties, additional costs and legal consequences arising from the circumstances set out in the above sections (Paragraphs) shall be borne by you without any liability to us.

7.5 Participants are responsible for being present at the meeting point and time that YELOFUN announces before the trips via e-mail or/and social media accounts. Our team is not obligated to wait for any late participants and all participants agree to this.

7.6 Participants cannot require a refund or cancellation due to being late for the bus or missing it. All participants must be present 15 minutes before the bus departure.

7.7 All participants must follow the YELOFUN coordinators’ announcements throughout the whole trip. Participants are expected to be on the bus or at the meeting points at given time. We are not responsible or obligated to assist with participants’ latencies and such.

7.8 When you attend a YELOFUN trip, you agree to have your photos taken as a group and such for the use of advertisement on our social media. These photos are only for social media, our website, and fliers. If you do not wish to take part in any photos or videos, you may talk to us beforehand and stay out of the frames.

 

8. CHANGE OF DEPARTURE PLACE

8.1 If there are less than 7 participants from a departure city, the departure point will be canceled. The travelers will be informed 2 days before the trip. In this case, the travelers have the option to get to the next departure city or get the full amount of money back.

 

9. BAGGAGE ALLOWANCE

9.1 Luggage allowance is one luggage and one hand luggage per person. Exceptions can be made upon request.  The requirements are as shown:

9.2 Hand luggage must be max.45cm x 30cm x 15cm and max. 8 kg

9.3 For 2-3 days trips, the luggage allowance is 1 luggage of max. 15 kg and hand luggage of 8 kg per person.

9.4 The luggage that is given to the bus carriage will not be accessible during the trip and only will be accessed when we arrive at our hotel/hostel. There may be complications and damages if this rule is broken and YELOFUN  has the right to take legal steps in this matter.

9.5 Participants may leave their belongings on the bus during the trips but passports, documents, perfumes, electronics, and all other valuable belongings are recommended to be with the participants at all times. Our team cannot be held responsible for any problems in this matter.

9.6 You are not allowed to take live animals, or dangerous or illegal goods with you on a trip carried out by YELOFUN. Any liabilities resulting from carrying such items will be borne solely by you.

9.7 Participants are responsible for the forgotten or damaged objects.

 

10. CONTRACTING PARTIES

10.1 The booking conditions detailed herein contain the entire contract between you and YELOFUN. No representation, term, warranty, or condition can be expressed or implied by reference to any other writing, advertisement, or conversation.

10.2 Your contract is with YELOFUN. We reserve the right to nominate to you in writing any other company or person to have the benefit of some or all of the provisions of this contract, which YELOFUN may then specify as if you had agreed to the provisions concerned directly with that company or person.

10.3 YELOFUN as a Travel Agency makes contracts directly with coaches, boats, hostels, hotels, and other service providers. All bookings with carriers and other service providers are subject to their T&C and limitations of liability. It is important to note that some of these limit or exclude liability in respect of death, personal injury, delay, and loss or damage to baggage. YELOFUN will not accept any responsibility for any loss as a result of such actions or as a result of any act or omission of any third party.

​10.4 Travel and accommodation services are provided by YELOFUN and they are contracted to third-party providers. They are subject to the T&C, and limitations of liability imposed by the service provider. By booking and paying for a tour, you agree to and accept the T&C in this document.
